HALIFAX - For the second time in less than two weeks, police in Halifax have confirmed that a man has been killed while allegedly taking part in a home invasion.
In the latest case, police said Monday that on Jan. 4, officers responded to a report that a 33-year-old man had been fatally shot inside a residence on Herring Cove Road.
An investigation determined that three people, one of whom was armed, invaded the home and they were fighting with the occupants when the gun went off.
Nova Scotia's medical examiner conducted an autopsy and determined the manner of death to be a homicide, but police say criminal charges are not being considered at this time in relation to the death.
A 21-year-old man, one of four people arrested at the scene, has been charged with carrying a concealed weapon, illegal possession of a firearm and possession of a dangerous weapon.
Const. John MacLeod, a police spokesman, said he could not speculate as to why criminal charges are not being considered in relation to the death.
On Dec. 30, 26-year-old Anthony Robert Herritt died from stab wounds during an attempted home invasion in Halifax.
Police say he was one of two men who allegedly tried to invade a home when they were confronted by a resident.
Investigators say an altercation between the three resulted in Herritt's death.
As with the most recent case, no criminal charges are being considered in relation to the killing.
A 28-year-old man has been charged with break and enter, assault with a weapon, possession of a dangerous weapon, wearing a disguise and breach of probation.
